1. About the website

WhenInX provides interactive online service via website of the domain Webgliders, managed by the company Webgliders LLC. On the web site “wheninx.com” certain companies (“Service’s administrators”) offer services. Only administrators of the services are responsible in front of you about the quality of the services. All offers and prices on the site can be changed at any time, without previous notification.

1. Ownership of the website

The site, the whole site content and the infrastructure that is used to make the site available are property of the provider. By using this site the final user and accepting all the rules and regulations stated further in the text (a)WhenInX allows you limited, personal, non-transferable, non-exclusive licence in order to use the site according to this Terms of use and all other additional policies and regulations set by WhenInX; and (b) you agree that you would not reproduce, distribute, transfer, resell any content, software or products or services received from the site without previous approval by WhenInX.

1. Use of the website

As a precondition to using the site, You agree that:

• you are at least 18 years old
  • you are able to make legal obligation
  • you are not legally forbidden to use certain services
  • you will not do any action on the site in order to draw information, like robots, crawlers and other tools used for drawing information.

WhenInX keeps the right to refuse to give service or access to the site or the profile of any person at any time for any reason. The final user acknowledges that although the internet is often a safe place, sometimes there are interferences in the service or events out of control of the Webgliders, and  it is not responsible if any of the information got lost during the information transfer via  Internet.

Although the purpose of the Webgliders is to be available 24 hours a day, 7 days a week, the site can be unavailable temporary for any reasons, including, without exception, daily maintenance.  You understand and acknowledge that depending on the circumstances, within or out of domain of Webgliders, the access to the website can be interrupted or suspended temporary.

1. Changes in the Terms of use

Webgliders has the right at any time to terminate or change any aspect from the Terms of use and/or Policy on Protection of personal information if it assumed as necessary or desirable. That kind of changes can be included, among other things, adding certain taxes or fees. If Webgliders makes any essential changes, we will inform you by sending you a message on your e-mail address registered with your profile and/or by posting a notification for the change on the website.

Any changes of this Terms of use will become effective after we inform you by sending an e-mail or after we post the notification on the website. These changes are not valid for already retroactively made offers, respectively services before the date when these changes will become effective.

In case you do not agree with the changes you may delete your profile without any fees and not to use the services of the site in after the changes.

1. Your profile

You could register and maintain only one profile on the website for personal use. You are responsible for your information update on your Profile. As part of the changes on your profile you have an option to: change, save or delete any personal information from your profile or to unsubscribe from receiving promotional e-mail messages. You know and you agreed that WhenInX does not have any responsibility for any incident that may came from or it is connected with your profile. You are solely responsible for maintaining the security of Your Profile. We would presume that any person that uses the site with your Profile is You. You agree that only you are responsible for any activity that happend on or with your profile. Your profile can be removed together with your assets, if the profile is not maintained with current information.

Your profile is not transferable. You may not share or sell with/on other person. Any violation of the Terms of use may result with the profile removing without previous notification. Removed or unregistering profile loses purchased vouchers, whether they are used or not, or other resources that are on the profile. Also, we have the right to change or remove any option from our website, without limitations on request for the use of the site.

1. Equipment for using the website

The final user is responsible to provide and keep of the telephone equipment, computer hardware and other equipment required for access and use of this site and all related expenses. Webgliders is not responsible for any equipment damage of the final user as a result of useing this site.

1. Code of conduct of final user

All interactions with the site must be in accordance with these Terms of use. In case we notice that Your behaviour disturbs or prohibits any other user to use any part of the site, we could restrict your access and use of the site.

The following activities are forbidden on the site and indicate violation and disrespect of the Terms of use:

Posting any content on the site that:

• violates implementable laws (including, without exclusion on: Intellectual property law, laws that refer to protection of personal information and laws that refer to defamation);  
• contains personal information, except if we clearly ask from you that kind of information;
• contains viruses or bad software that could do any harm;  
• offers downloading to protected, confidential or personal information;  
• has the effect of imposing on the others;
• contains messages from notauthorized persons from Webgliders, that allegedly communicate in the name of the providers or give confidential information;
• on purpose inappropriate content, that represents fraud or falsify information; or
• is protected with copyrights, trademark or any other type of intellectiual property without clear approval from the owner of the copyright, trademark or other intellectual property.

The attempt to make or actually make anything from the following:

• Accessing information that are not intended for You, like loging into the server or profile that you are not authorized to access;
• Scaning or following the site in order to collect information, attempting to follow the purchase, using, aggregated information for the offers, information about the prices or similar information; or

• the site or any of its resources in order to gain users, merchandisers or other third parties to became users or partners on other online or offline services directly or indirectly competitive or potencially competitive with Webgliders, without excetion, gathering current or previously proposed offers.  

Collecting any of the following stated activities:

• site content, without excetions, on the current or previous proposed promotional offers and afterwards presenting the content to the users in any way in order to redirect the user from the site toward other third party without our written approval;
• personal information (defined in the Policy on protection of personal information), User content (defined in paragraph 13 bellow) or the content from any user or administrator of the service;   

Including any of the following activities:

• invasion or interference of the properly functioning of any part, page or domain of the site or any of the functions or services secured by WhenInX;
• undertaking any action that creates excessive demand of our services or instruct, or may impose, unreasonable or disproportionate overload of our servers or other parts of our infrastructure;
• reselling of any purchase made via the site;
• accessing, following or copying any site content, by using “robot”,”spider” or any automatic resources or any manual process for any purpose, without our written approval;
• aggregating or presenting any current or previous offers or content or other information from the site (regardless whether you use links or other technical resources or physical records connected with the purchases made on the site) with materials from other sites without our written approval;
• deep connection with any part of the site ( without exception, track for purchasing any voucher) without our written approval;
• connecting with the site via any website without our initial or current approval; or
• operating illegally or maliciously against the business interests or reputation of the provider Wegliders, our associates respectively service administrators or our services.

By purchasing or receiving any offer from the website provided by any associate respectively provider of the services, You agree with the Terms of use, including Terms of purchase, available here.

By participating in any program, marketing promotion, game or any activity organized by the Webgliders you agree with the Terms of use.

1. Copyright and trademark

The site contains protected material, copyrights, trademark and other ownership information, without exception, text, software, pictures, videos, graphics, music and sound. Everything that can be found on the site is in exclusive ownership of the Webgliders LLC. The provider has copyright over the selection, choosing, coordination or modification of the content as well as the content that originaly owns.

Also, the provider has copyright over the photographs that he owns, as well photographs that are taken for the purpose of the offers. EVERY COPYING, DISTRIBUTING, TRANSFERING, POSTING, PLACING LINKS, MODIFICATING, TAKING PART IN THE PURCHASE, OR IN ANY KIND MODIFICATION OF THIS SITE OR IN THE MIKROSITES, OR IN ANY WAY USING THE CONTENT, PARTLY OR FULLY WITHOUT STATED WRITTEN APPROVAL FROM WEBGLIDERS LLC IS STRONGLY FORBIDDEN. Webgliders does not bear the burden or responsibility, to give the indication to the final user in order to learn whether certain material is protected under copyright or trademark law. The final user only is responsible for any damage that cames from every violation of the copyright, trademark, ownership law or any other damages that came from that kind of actions.  By placing materials on any public area on the site, the final user guarantees that the owner of this material has gave explicit non-exclusive right and permission for use, reproduction, modification, right to post, translate or distribute such material from the provider. The final user, also agrees to give the right to any other final user to copy, modify, post and distributeany material placed on the site by the final user.  

WhenInX is protected trademark by Webgliders LLC. All rights regarding this mark are reserved. Unless it is stated otherwise, all others trademarks that appeared on the website are owed by their corresponding owners, i.e.  respectively to the associates.

1. User content

This site allows registrated users and visitors more options to view and post opinions, advices, ratings, discussions, comments, messages, responses and other communications, as well attaching files, pictures, photographs, video, audio files, music works and other contents (all named “contents”) via forums, notice boards, discussion groups, virtual rooms, polls, blogs or other communication channels that can be offered on, through or in connection with this site from periodicly.  

If you post any content, you guarantee that: (a) you are the creator of the contents, or (b) you act in the name of the creator, that you have (i) stated consent from the creator to post and modify contents and (ii) all right necessary for assigning licence in these Terms of use. Also, you guarantee (or if you act in the name of the creator of the contents, you have ensured the creator to state and guarantee) that sharing of the contents for the aims that you have chosen does not violate copyrights, trademarks or other laws on intellectual property or the right of third parties, including the law on publicity and privacy. You guarantee that you may not upload, send, transfer or in any kind place on disposal contents that are unlawful, harmful, treating, insulting, racist, pornographic, indecent, violative, false, defamatory, invasive of the privacy of other person or harmful for any third party; or if the contents contain any matrial that hides viruses or any other computer codes, file or programs design to stop, destroy or limit the functionality of any software or computer equipment.

Webgliders has solely and absolutely right, but not an obligation, to review, to modify, to post, to remove, to follow user contents and to revail contents and circumstances of their transfer by any third party, at any time, by any reason, including to confirm the adjustment with these Terms of use and all applicable laws, regulatives and authorized government requests. Without any restrictions of the previous said, Webgliders has the right to remove any content from the communities or any other site under the control of WEBSPOT, in its solely and apbsolute discretion. Webgliders does not take responsibility for any contents or other information that appear or are removed from the site or at any other place. Webgliders does not have responsibility to use the user’s contents in general.

In some cases, periodlicly, Webgliders may be available to modify or remove contens delivered or send from your profile. Wegliders does not give any guarantee that the user’s content that you have modified or removed, will be modified or removed on the site or at any other place, or that the content will not be shown anymore on the internet, browsers, social media or in other form, media or technologies.

User-generated content:

• You understand and agree that the user content is public. All discussion about the rating, comments, notice board, virtual spaces for discussion and/or other mefssages and resources for communication are public, not private messages, and according to that the others can read the communication. Every person (whether is or is not user of the services from Webliders) can read your content without your knowledge. Please do not use any personal information in your contents, unless you do not want them to be publicly published. Webgliders is not responsible for the use or disclosure of any personal information that you publish as user content.
• Any content from any type made by you or any third party is made by the corresponding author(s) or distributer(s), not by Webgliders. Other users may publish content that are inaccurate, incorrect or deceptive. Wegliders does not support and is not responsible for any user content, and may not be responsible for any damage or loss caused by your supporting of that type of content. User content reflects the opinion of the one that proposes, not the opinion of the Webgliders. Webgliders does not control or approve any published contents, and particularly dissociates from any responsibility about your contribution towards the use or relying on any user content and any actions that arise from the participation in any part of the site, including all inappropriate and indecent user’s content.

Approval / licence

• Some user content that you leave on Webgliders may be presented or you may be given an option to present them together with your personal information, without exception, your name, initials, user name on the social media, picture, likes, preferences, voice and location. To Webligers you offer freely, irreversibly, irrevocably, non-exclusively, transferably, effectively around the world the right to use, display, distribute, offer to purchase and to purchase personal information related with your contents, whether your contents are presented independently or as part of other things, as well in any form, medium or technology, whether now known or developed in the upcomming period, without any compensation for you. However, Webgliders may not have obligation to use your personal information related to any user’s content.
• Regarding the connection between You and Webgliders, you keep the ownership right over the content you publish. To Webliders You offer freely, irreversibly, irrevocably, non-exclusively, transferably, effectively around the world the right to use, display, distribute, offer to purchase and to purchase personal information related with your contents, whether your contents are presented independently or as part of other things, as well in any form, medium or technology, whether now known or developed in the following period, without any compensation for you. To Webgliders you offer the moral right and all other rights you may have according to the laws, that originate from the ownership of such content or integrity of the materials in connection with your pusblished user content. WhenInX licence to use the user content or personal information submitted with the content, include but it is not limited on the use of the same for advertising, marketing, promotions, market research, allows feedback for the dealers, quality control and for other legal purposes.
• As previously mentioned, displaying user’s content is allowed only for persons at age +18. The site is itended and designed for adults. By displaying content on the Wegliders you confirm that you are of legal age. We will immediately remove the user content if the person is under 18, as soon as we get informed.

1. Unwanted ideas

We do not accept or take into consideration any of the unwanted ideas transferd directly or through some employees in the Webgliders, without exception, ideas or proposals that refer to the new services or improval of the existent, names or technologies, advertising and marketing campaigns, plans and other promotions. Do not send us, or to any of our employees, unwanted ideas, proposals, materials, pictures and other things in any form (“Unwanted materials”). If you send unwanted materials, you understand and you agree that the following conditions will be applied, nevertheless if it is motivation letter or other materials that you have sent:

• Webgliders does not have the responsibility to view any unwanted materials, neither to keep them confidential; and  
• Webgliders owns, and may use and redistribute the unwanted materials for any purpose without previously to inform the sender.

Webgliders keeps the right to terminate the contract with any user, who permanently breaks the copyright law of third parties, based on previous on-time announcement from the Webgliders by the owner of the copyrights or legal agents of the owner copyrights. WheInX, as any Internet service provider, is distributior (not publisher) of contents, secured by third parties and final users. According to that, WhenInX does not have editorial control over of that content as any public library or book-shop. Every opinion, advice, report, service, offer or other information or content expressed or put on disposal by third parties, including information about the services or any other information from the final user correspondents to authors or distributrs and not from WhenInX.  

In many cases the content available on this site represents opinions and views of certain people that provided the information, of the final users, or other users on agreement with Webgliders. Webgliders does not supports nor is responsible for the accuracy and authenticity of any opinion, advice or statement on the site by anyone, except from authorized Webgliders employee. Under none circumstances, Webgliders is responsible for any loss or damage on the final user evoked by his relying on the information receive throught the site. Responsibility to the final user is to evaluate the accuracy, completeness and usefulness of any information available on this website.

1. Damage compesation /discharge

You agree to defend and protect WhenInX and its empoyees, manigers, agents from any accusations and expenses, including lawyer costs that arise from or are connected with: (a) any voucher that you have purchased from the site, (b) any content posted by you, connected with the site or any use of the site that violates the Terms of use, (c) any fraud that you have made it or (d) braking any law from Republic of Macedonia or foreign laws or rights of third persons.

The final user agrees that he/she will compensate and will not consider the company Webgliders LLC as responsible, including its manigers, employees or agents, for all requests for damages or expenses, including the expenses about legal representation, that may arise from the use of this website by the final user.

1. Major force

Webgliders will not be responsible for the functioning of this website according to the Terms of use, to the extent that the same is evoked or postponed, partly or fully as a result of some event or series of events that are caused by: (a) natural disasters or any action of the nature or major force, (b) war, terorism, civil wars or revolutions, (c) embargo or quarantine, (d) strikes and lockouts, (e) mistake or interruption on the computer hardware, networks or software or (f) other circumstances.
